Placing a perfume on the marketplace is an extremely costly venture. So is creating any other naturally derived or synthetic fragrance for the food, beverage, personal care or household / chemical industries. Protecting against competitive imitation becomes imperative in the age of gas chromatography and mass spectrometry, where secrecy proves no longer effective. The European Union is about to pass new pieces of legislation that will enhance the current means of protection for the fragrance & aroma industries at both national and EU level. This presentation gives an overview on how to protect fragrances and smells under trade mark, copyright and patent law.

Sergio BALAÑÁ-VICENTE is a member of the Barcelona Bar Association. He graduated from the University of Barcelona and holds a Master of Laws (LL.M.) by Queen Mary & Westfield College, University of London. Prior to setting his own Firm, Sergio conducted research work in several European and US universities leading to a DEA. He has extensively published papers in both national and foreign journals, particularly in the area of Intellectual Property Law. Sergio has been granted ‘visiting research fellow’ status at Columbia University in the City of New York (USA), at the Max-Planck-Institut for Innovation and Competition in Munich (Germany) and at the Institute of Advanced Legal Studies in London (UK). He specializes in Litigation (civil, commercial and administrative), Commercial Transactions, Corporate Law, Intellectual Property (both contentious and non-contentious), Real Estate, and Regulatory (TMT, Pharma & Life Sciences, Transportation, Insurance Law and Environmental Law). Besides Spanish, he is fluent in English, French, German and Italian.
